Such amendments will not apply to contracts entered into under section 1847 of the Social Security Act (42 U.S.C. 1395w–3) which allows medicaid to pay 80%. The new Bill states that ‘ pursuant to a bid submitted under such section before October 1, 2010, under sub may be phased in first among the highest cost and highest volume items and services or those items and services that the Secretary determines have the largest savings potential’. Another words, As of Jan.1,2011 if there’s a cheaper alternative you will no longer qualify for a ‘‘complex rehabilitative power-driven wheel chair".
