Drunk Driving question?

If you go to the bar in a Electric Wheel Chair or a mobilty device if you leave drunk, and get caught by the police is that a DUI?
I have literally seen people in Indiana be arrested for "OWI" (Operating While Intoxicated) for riding bicycles drunk. So I would guess anything that one is operating while under the influence could be a danger to themseleves or others, therefore, I believe you could be charged.
For example you get on your "Rascal" and drive it down the road, impeding traffic, or cause an accident by driving into traffic etc….that kinda thing.
It would be best to consult an attorney or maybe a police officer regarding the DUI laws in your state etc.
The cops have quite a bit they could charge a "drunk" person with…even simple Public Intoxication if they want to.
Depends on how big a prick the cop is really.

2010 Feb 14 3That is a good question. I would have to assume you can since I have heard of people being picked up for DUI while on bikes, rollerblades, or skateboards. Clearly they are looking for those operating cars as this is more dangerous. You should be alright as long as you don’t do anything to draw their attention.

2010 Feb 14 5It depends on the state. Some the way the law is written allow this, others the way it’s written, it has to be an actual car. It depends on how your state defines motor veichle.

2010 Feb 14 8I seen recent articles about people being charged with DUI, or an equivalent offense while riding a horse. Even without the ‘vehicle’ public intoxication is a crime in some places. My advice is not to be drunk. That solves the problem.

2010 Feb 14 9You need to check your specific state’s laws on what is constituted as a motor vehicle. Usually DUI is chargeable when someone is operating a motor vehicle IE: any vehicle who’s operator must conform with the motor vehicle laws and traffic code. It doesnt just apply to a vehicle with an engine in it. Cyclists and rollerbladers must adhere to motor vehicle laws in some states.
You may also be charged with public intoxication. But that is a whole different charge. Call your local court and ask for a copy of the law.

anytime a cop sees an easy night of paper work and lounging,they jump on it.and right around the corner real criminals are punching 90 year grandmas in the head.
never met a cop who wasnt an brownhole.
